1. Who we are
Upland Nutrition ("we," "us"), based in Texas. Contact us about privacy at [email protected].
2. What we collect
- What you give us: your first name (optional), email address, track choice (Core or 50+), the consent box you ticked and when, messages you send us, and your community posts and profile.
- Purchases: handled by Whop. We receive your name, email and purchase details. We don't see full card numbers.
- Our 60-second quiz: taking the quiz is optional. It asks 6 lifestyle questions (age group 30–49 or 50+, how often you do strength work, time available, equipment at home, which meal is hardest for protein, optionally whether you mostly eat plant-based, and your goal) and shows your result on screen. Your answers are saved without your name or email. Your first name and email are saved only if you enter them and tick the consent box, together with the date and the consent wording you agreed to. The quiz never asks about medications, conditions, injuries, pregnancy, weight or measurements, and has no free-text health box.
- Automatically: our website host, Cloudflare, processes technical data such as your IP address, browser type and the pages you request, to deliver the site and protect it from abuse. When the signup form on our starter-guide page loads, our email provider EmailOctopus (and Google, if spam protection with reCAPTCHA is turned on) receives similar technical data. EmailOctopus records whether our emails are opened and links clicked. Whop uses its own tracking on Whop pages.
- We do not ask for health information. Our forms and checkout never ask about medications, conditions or weight. If you choose to share health details in community posts, other members can see them.
3. How we use it
To show your quiz result and improve the quiz (we look at answer totals, not individuals), deliver the free guide and anything you buy, send the emails you signed up for, run the community, answer support requests, improve our content, prevent fraud and abuse, and meet legal obligations.
4. Where our services are offered
Our programs are designed for people in the United States.
5. How we share it
We share personal information only with service providers who help us run the business:
- EmailOctopus (Three Hearts Digital Ltd, UK): our email list and email sending. It stores our subscriber list on Amazon Web Services servers in the European Union, primarily Ireland.
- Google: quiz answers and quiz opt-ins are stored in a Google Sheet in our own Google account. Google also provides reCAPTCHA spam protection if it's turned on for our signup form.
- Cloudflare: hosts this website, protects it from abuse, and forwards emails you send to our @uplandnutrition.com addresses to our inbox.
- Whop: payments, memberships and the members' community.
Affiliate partners only receive click data through their own links. We don't sell your personal data, and we don't share it for targeted advertising. We may share information if the law requires it, to protect our rights or safety, or as part of a business transfer.
6. Email and your choices
Every marketing email has a one-click unsubscribe link and our postal address. We honor unsubscribes promptly, as required by the CAN-SPAM Act.
7. Cookies and tracking
This website doesn't use analytics, advertising cookies or tracking pixels (such as Meta or TikTok). The quiz page loads no third-party scripts at all: your answers are scored in your browser and sent once, when you tap "Show my result." The signup form on the starter-guide page is loaded from EmailOctopus, which may use its own cookies or Google reCAPTCHA to stop spam; see EmailOctopus's privacy policy. If we add analytics or advertising later, we'll update this policy first.
8. How long we keep data
Quiz answers without an email: deleted after 12 months. Email subscribers, quiz emails and consent records: kept while you're subscribed, then deleted within 30 days of unsubscribing, except a minimal suppression record so we don't email you again. Purchase records: as long as tax law requires.
9. Security
We use reasonable safeguards, but no system is 100% secure.
10. Children
Our programs are for adults 18 and older. We don't knowingly collect information from children under 13.
11. Your rights
You can ask to access, correct or delete your information, including your quiz answers and email, or opt out of marketing. Email [email protected] from the address you used. We'll respond within 45 days. Quiz answers given without an email can't be linked to you, so we can't find them to delete. If we decline your request, you can appeal by replying to our decision, and we'll respond to the appeal within 60 days.
12. State privacy laws
Depending on where you live, you may have additional privacy rights. We don't sell personal data, don't use it for targeted advertising, and don't knowingly collect sensitive or consumer health data. To use any of your rights, email [email protected].
13. International processing
We're based in the United States. Our service providers may process data in the United States and other countries; EmailOctopus stores our subscriber list in the European Union.
14. Changes to this policy
If we change this policy, we'll update the date at the top. If a change is significant, we'll also tell subscribers by email before it takes effect.
